You may use the Service only in accordance with these Terms and all applicable laws. You are responsible for all activity that occurs under your account.

2. User Responsibilities

• Upload or transmit content that is offensive, harmful, or violates third-party rights.
• Attempt to reverse engineer, interfere with, or disrupt the Service.

3. Data Collection and Privacy

By using our Service, you consent to the collection and use of personal information (e.g., name, phone number, GPS location, photos) as described in our Privacy Policy.

You understand that data submitted through the Service — including GPS coordinates, photos, timestamps, and visit notes — is user-generated and may not accurately reflect the actual location, time, or work performed. Vendor Onsite does not verify the accuracy of any user-submitted data.

4. SMS Communications

By entering a phone number into the Service, you agree to receive SMS messages for visit scheduling, check-ins, and operational purposes. You may opt out by replying STOP at any time.

5. Data Accuracy and Disclaimers

The Service is intended as a lightweight scheduling and visit-tracking tool only. We do not guarantee the accuracy, completeness, or legal sufficiency of any visit data for use in audits, billing, compliance, or service-level agreements (SLAs).

We are not responsible for:

• The accuracy or legitimacy of GPS data, photo submissions, or check-in timestamps provided by users.
• Verifying or endorsing the actions of technicians or vendors using the Service.
• Ensuring service availability or SMS delivery.

6. Limitation of Liability

To the maximum extent permitted by law, Vendor Onsite LLC shall not be liable for:

• Any indirect, incidental, special, or consequential damages;
• Loss of data, revenue, reputation, or business opportunity;
• Any claims arising from user content, third-party services, or system errors.

In no event shall Vendor Onsite LLC's total liability exceed the amount paid by you (if any) for use of the Service in the twelve (12) months preceding the claim.

7. Indemnification

You agree to indemnify and hold harmless Vendor Onsite LLC and its affiliates, officers, and employees from any claims, damages, or legal fees arising out of your use of the Service or your violation of these Terms.

8. Termination

We reserve the right to suspend or terminate access to the Service at our discretion, without notice, if you violate these Terms or misuse the platform.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.

10. Third-Party Services

Vendor Onsite relies on third-party providers for SMS delivery, hosting, and mapping services. We are not responsible for the performance, availability, or security of these third-party services. Use of such services is subject to their own terms and privacy policies.

11. No Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee uninterrupted access, error-free operation, security, or that the Service will meet your specific needs.
